Eligibility of an EB-5 Investor Visa

The Immigrant investor Program, also known as the EB-5 Regional Center Program allows foreign investors to become lawful permanent residents through investment and job creation. This program is subject to a yearly cap. EB-5 investors make up to 7.1% of all employment-based immigrant visas issued by the United States annually.

To be eligible, an applicant must invest either US$1,800,000 or US$900,000 in an area of the country where there is high unemployment. Also, the investment should enable the creation of full-time jobs for 10 US citizens or lawful permanent residents, including immigrants on work visas. The employees cannot be members of the investor’s family, such as their spouse or children.

The investment can be in the form of either cash, tangible property, inventory, equipment, secured indebtedness, or a cash equivalent of the amount mentioned. The EB-5 Investor Visa Program is run by the United States Citizenship and Immigration Services (USCIS) and was established by the US Congress in 1990 to encourage investment and support the economy.
